This notice explains how Proxima Beta Pte. Limited, operating as Level Infinite (“Level Infinite”, “we”, “us” or “our”), handles personal data in connection with giveaway activities and the taking and use of photographs, video footage and audio recordings at the Level Infinite booth. The relevant booth activities feature Dune: Awakening, Hunt: Showdown, Control Resonant and Exterminauts (the “Featured Games”).

1. Who is responsible for your personal data?

Proxima Beta Pte. Limited (Level Infinite) is the controller responsible for the processing described in this notice. You can contact us or exercise your privacy rights using the privacy contact details and request channels provided in the Level Infinite Privacy Policy.

2. What activities does this notice cover?

This notice applies to:

•    onsite giveaway activities at the Level Infinite booth;

•        general photography and filming of the booth, crowds and event activities;

•        photography, filming, interviews or other recorded participation connected with any of the Featured Games; and

•        the selection, editing, publication and reuse of event imagery and footage on websites, social media and other Level Infinite promotional channels.

3. What personal data do we process?

Giveaway activities

We generally do not collect or retain personal data to administer onsite giveaways. Prizes are distributed immediately onsite, and game codes, where applicable, are not linked by us to player accounts for giveaway administration. We do not record winners’ names, email addresses, phone numbers, account details or other identifiers for prize distribution. Event staff may visually verify eligibility but do not create or retain an eligibility record unless this is separately explained to you.

Photography, video and audio

Photographers, videographers and authorised event staff may process the following data:

•        your image, likeness and physical appearance, including clothing, costumes or cosplay;

•        video footage showing your movements, reactions, gameplay, participation and interactions at the booth;

•        your voice, statements, interview responses or other audio captured during filming;

•        the Featured Game activity, booth location, date and time associated with the recording;

•        captions, descriptions, accessibility transcripts and other contextual information added during production; and

•        a public social media username or tag only where you voluntarily provide it, request to be tagged, or interact with our published content.

We do not use event imagery for facial recognition, biometric identification, automated decision-making or profiling under this notice.

4. Why do we process the data and what is our legal basis?

Our legitimate interests under Article 6(1)(f) GDPR in documenting and evaluating our event participation.

Capturing general crowd scenes, booth activity and incidental appearances; creating and publishing event recaps and promotional content about Level Infinite and the Featured Games.

Our legitimate interests under Article 6(1)(f) GDPR in communicating about our games, products, communities and events, balanced against attendees’ rights and reasonable expectations.

Taking and using posed photographs, close-ups, interviews, testimonials, directed performances or recordings in which you are a main subject.

Your consent under Article 6(1)(a) GDPR where consent is required, including where required by applicable German image and personality-rights rules. Staff may ask you to confirm your permission before or at the time of recording.

Entering the booth or a generally filmed area is not treated as consent to a posed photograph, interview or other recording in which you are the main subject. Where we rely on legitimate interests, you may object as explained below.

5. How may imagery and footage be used on social media?

Selected material may be reviewed, cropped, edited, subtitled, translated, combined with game artwork, logos, music or other event material, and used in posts, stories, reels, shorts, livestream recaps, highlight videos and similar formats. It may be published or reshared through official Level Infinite, affiliated-company or Featured Game channels, including websites and social media or video-sharing services such as Instagram, TikTok, YouTube, Facebook, X and Twitch, as relevant to the campaign.

Published content may be visible globally and may be liked, commented on, shared, downloaded, copied or reposted by other users. We will take reasonable steps to remove content from channels we control when legally required, but we cannot guarantee deletion of copies independently made or retained by third parties.

Third-party platforms. Social media and video-sharing platforms may process information about your viewing or interaction with a post for their own purposes and under their own privacy terms. They may act as independent controllers for that processing.

6. How can you avoid being filmed or raise an objection onsite?

Photography and filming notices will be displayed in or near relevant booth areas. If you do not wish to be photographed or filmed, please avoid clearly marked recording areas where reasonably possible and tell a photographer, videographer or Level Infinite event staff member. We will take reasonable steps to respect your request, for example by not deliberately filming you, changing the camera angle, or excluding identifiable footage during editing.

If you are asked to take part in a posed photograph, close-up or interview, you may decline without affecting your ability to visit the booth or participate in other activities, subject to any separate activity rules.

7. Who receives the data?

Event imagery, footage and related production data may be accessed or received by:

  •    authorised Level Infinite personnel and affiliated companies;

  •    teams and business partners supporting approved content for the              Featured Games;

•        event organisers, photographers, videographers, production crews, creative agencies, localisation providers, media agencies and IT or hosting providers acting for us;

•        social media, livestreaming, video-sharing and website platform providers; and

  •    members of the public when content is published.

Service providers acting on our instructions are required to protect the data and use it only for authorised purposes.

8. International transfers

Level Infinite, its affiliated companies, service providers and online platforms may process event material outside the European Economic Area (“EEA”), including in countries that may not provide the same level of data protection. Where required, we use appropriate safeguards under Chapter V GDPR, such as an adequacy decision or the European Commission’s Standard Contractual Clauses, together with supplementary measures where appropriate. Information about relevant safeguards may be requested through our privacy contact channels.

9. How long do we retain the data?

•       Giveaway administration: no participant data is retained where the prize is distributed immediately and no separate record is required.

•       Raw or unselected recordings: retained only for the period reasonably necessary to review, select and produce event content, then deleted or de-identified in line with our retention procedures.

•       Selected and published content: retained for the relevant campaign, communications and archival period, subject to periodic review and deletion or de-identification when it is no longer reasonably necessary.

•        Consent and rights-request records: retained as needed to demonstrate permissions, respond to requests and establish, exercise or defend legal claims, subject to applicable limitation periods.

Actual retention may be shorter where you validly withdraw consent or object and there is no overriding lawful reason to continue the processing.

10. Children and young people

The giveaway is not intended for unaccompanied minors. Minors may participate only where permitted under event rules and with appropriate involvement of a parent or legal guardian. We do not intentionally conduct a close-up, posed recording or interview with a minor without appropriate parent or guardian permission where required. General crowd footage may incidentally include minors; reasonable care will be taken in selecting and publishing such material.

11. Your rights

Subject to applicable law, you may have the right to request access, correction, deletion or restriction of your personal data, to receive certain data in a portable format, and to object to processing based on legitimate interests. Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect processing that was lawful before withdrawal.

To help us locate an image or recording, please provide available details such as the event date and approximate time, the Featured Game area, your clothing or appearance, and a screenshot or link if the content has been published. We may need to verify your identity before completing a request.

You also have the right to lodge a complaint with a competent data protection supervisory authority, including the authority in the EEA country of your habitual residence, place of work or the alleged infringement.

For questions, objections, consent withdrawal or other privacy requests, please use the privacy contact details and request channels in the Level Infinite Privacy Policy. If you are at the event, you may also speak to Level Infinite booth staff, who can direct your request to the appropriate team.

Event reminder: Photography and filming take place in parts of the Level Infinite booth. Please follow onsite signage and speak to event staff if you do not want to be deliberately captured or if you have concerns about a particular recording.

This event-specific notice supplements the Level Infinite Privacy Policy. If another activity at the booth collects additional personal data, a separate or additional notice will be provided.
